These terms and conditions govern your access and use of www.andylaviolette.ca, including the sale of digital photographs, user accounts, and premium blog content for paid subscribers where applicable. By accessing or using this website, you agree to be bound by these terms and conditions.

2. Intellectual Property Rights

2.1 Ownership: All content, including but not limited to text, images, graphics, logos, and digital photographs, available on www.andylaviolette.ca is protected by intellectual property and copyright laws and is the exclusive property of Andy Laviolette.

2.2 License Grant: www.andylaviolette.ca does not grant you a non-exclusive, non-transferable license to use the digital photographs for personal, non-commercial use. You may not reproduce, distribute, or resell the digital photographs without express written permission obtained.

3. User Accounts

3.1 Account Creation: To access certain features of www.andylaviolette.ca, including the members' area, you may need to create a user account. You agree to provide accurate and current information during the registration process and to keep your account credentials confidential. You are solely responsible for all activities that occur under your account.  Please review the member code of conduct.

3.2 Account Termination and Suspension: www.andylaviolette.ca reserves the right to suspend or terminate user accounts at any time and for any reason, including but not limited to a violation of these terms and conditions, member code of conduct or illegal activities.

4. Blog Content:

4.1 Subscription Fees: Access to exclusive blog content on www.andylaviolette.ca does not require a paid subscription. By subscribing, you agree to have e-mails sent only as outlined on the website content for when something is posted. The subscription fees, while are free for members, those that do not follow member code of conduct will have their subscription terminated. You agree if you shall terminate your lifetime subscription you will not be able to subscribe at a future date.

4.2 Content Delivery: The blog content provided to subscribers on www.andylaviolette.ca is for personal use only. You may not distribute, share, sell, or publish the content without express written consent from Andy Laviolette. The subscription blog content as defined under Section 2 Intellectual Property Rights of these Terms & Conditions apply also to it's subscribers on www.andylaviolette.ca

5. Limitation of Liability

To the extent permitted by law, www.andylaviolette.ca shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages arising out of your use of the website, including the use of viewing digital photographs, text, user accounts, or blog content.

6. Governing Law and Jurisdiction

These terms and conditions shall be governed by and construed in accordance with the laws of Canada. Any disputes arising under or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts in Canada where the end user will incur all costs at their expense.

7. Modifications and Updates

Andy Laviolette and the team involved with www.andylaviolette.ca reserves the right to modify, update, or replace these terms and conditions at any time, without prior notice. It is your responsibility to review this page periodically for any changes.
